To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of or in connection with these Terms shall not exceed the total subscription amount paid by the client.
9. Dispute Resolution and Governing Law
- Any disputes arising out of or in connection with these Terms shall be resolved in order through:
- 1. Negotiation: In the event of any dispute arising out of or relating to this Agreement, the parties shall initially seek to resolve the matter through direct negotiation. A party initiating the dispute shall provide written notice to the other party outlining the details of the dispute. Both parties shall use their reasonable endeavors to consult and negotiate in good faith to reach a mutually acceptable resolution within 30 days of the notice.
- 2. Online Dispute Resolution (ODR): If the dispute is not resolved through negotiation within the aforementioned timeframe, the parties agree to submit the dispute to the European Union's Online Dispute Resolution (ODR) platform. Both parties shall actively participate in the ODR process in an attempt to find a settlement.
- 3. Mediation: If the dispute remains unresolved after the ODR process, the parties may, by mutual agreement, elect to refer the dispute to mediation in accordance with a recognized mediation procedure. The parties will jointly appoint a neutral mediator and share the costs of the mediation equally.
- Governing Law: This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Portugal and the European Union except when the transaction or use of the service(s) is made within the United Arab Emirates Territory, in such case the Governing Law would be that of the United Arab Emirates.
10. Changes to Terms
- We reserve the right to modify these Terms at any time.
- We will notify you of any changes by email to your registered email address.
- Your continued use of the Site after any changes constitutes acceptance of the new Terms.
